Bicycle Accidents Bicycles are a common means of recreation and transportation. Bicycle riders under the age of (16) are required to wear a safety helmet and generally bicycles and mopeds on a roadway have the same rights and duties as drivers of motor vehicles. Bicyclists should be aware of traffic conditions where the bicyclist is required to ride his bicycle on the roadway and often times in conflict with the traffic and motor vehicles. Should an injury occur as a result of an automobile striking a bicycle rider, the bicycle rider falls and coverage could be provided under the household auto policy. The bicycle rider may be in the same position as a pedestrian. This means that the bicycle rider could be afforded $10,000.00 in no-fault coverage to pay medical expense and wage loss during recovery. If the operator of the automobile is negligent and the bicycle rider receives serious and permanent injuries, that rider could bring a claim against the owner and the operator of the motor vehicle. Unfortunately a large number of automobiles have been insured only as required under the State's Statutes for property damage liability in the amount of $10,000.00 and personal injury protection coverage in the amount of $10,000.00. Since that automobile may not carry any liability coverage for bodily injury, an attorney may be consulted to determine if there would be any coverage under any other automobile policy.
