On Friday April 8th there was a rollover accident after school near Pleasant Grove High School that was followed up by an after school accident on April 13th near Elk Grove High School that sent a car into the creek. The Accident near Elk Grove High School required the Elk Grove Fire Department to extricate the driver from their car. Both accidents happened within minutes of school being dismissed.
As summer approaches students get more and more excited and tend to pay less attention to the complex skills that are required while driving. It is a well known fact and something we have written about that drivers are increasingly distracted and that has resulted in more infractions and accidents. The Elk Grove Police Department recently had a distracted driving campaign because of the increase that has been seen both locally and statewide.
Knowing all of these facts we will stipulate that simply because a student is involved in an accident they are not automatically at fault. Distracted driving is not unique to students. The additional reality is that no matter the age of the driver or who is at fault there is no one who wants to be involved in an accident or get injured as a result of a distracted driver. Every attorney in our office has children in high school that are of driving age so we are very sensitive to this issue.
