We are all prone to rants from time and to time. Sometimes folks may even have the temerity to tell me to not be quite so serious. Whenever I read a story like I read this morning from San Francisco I get serious and I tend to stay serious!
In San Francisco this week the Board of Supervisors approved a settlement of $2.25 Million dollars in a claim against the Palace Of Fine Arts after a woman was injured at 2:30 in the morning while using an architectural feature of the building as stairs. After reviewing the pictures it occurred to me that any reasonable person might do the same thing! The really frustrating part is that a woman was permanently injured, the venue knew this was a problem, they had signage in place and allowed the signs to deteriorate so badly that no one knew what they actually said! I am waiting for the next story about the trial lawyer making a mountain out of a molehill when the mountain should have never happened in the first place and no one should have been injured.
Reading further the defendant was aware that the signs warning of the risks that were well known to the staff were worn to the point of being unreadable by people using the property and a jury determined that the lack of a warning was the primary cause of her permanent injuries. The lady that was injured fell 10 feet leaving her without sensation or movement in parts of her body. Three years earlier the city was sued for the exact reason and as a result of that they were on notice of the danger. The city took the reasonable step of initially installing signs and they were negligent in maintaining those signs alerting users of the risk. The Attorney for the Palace of Fine Arts said "Every litigation settlement we recommend reflects a thorough assessment of the facts and law and our best judgment of the most prudent course for the city and its taxpayers and this case is no exception."
