Injuries and deaths as a result of crashes are rising at a rate we have never seen before. We are calling them crashes because they aren't really accidents. This is the conclusion of a growing number of safety advocates, federal officials and state and local leaders across the country. Preliminary estimates by the National Highway Safety Council show that deadly crashes rose by 8 percent in 2015 over the previous year and this killed 38,000 people. This result alone has created a rising chorus of voices looking for clarity in definition.
The term accident means something like "God made it happen" and that is just not the case any longer. Almost every crash results from drinking, eating, distracted driving and other controllable factors. Less than 6 percent of accidents statistically are the result of weather, vehicle malfunctions and other situations. Driving remains the singular most dangerous activity for most people and that is increasingly due to the apathy many of us have for the process of driving. We had a client report to us that he witnessed another driver who was driving a car while talking on their hand held phone and eating with children in the car. There was lots of activity in that car with minimal concern for safety.
Nevada is one of a growing number of states that has changed the term in their vehicle code from accident to crash and San Francisco recently did the same thing. The word accident is defined as "an unexpected happening not due to any fault or misconduct on the part of the person injured." Local, state and federal authorities work tirelessly to warn us of the risks of crashes with very little to show for their efforts. In our office we see the ramifications of crashes and we know from listening to the facts that the majority of these are preventable.
