Deadly Distractions Other Than Cell Phones

News reports make it appear that all cases of distracted driving are related to cell phones and texting. This is simply not the case according to the National Safety Council. Since cell phone usage accounts for just over 50% of driving distractions it is worth looking at the "rest of the story."

Does Friendly Only Start Once You're Airborne?

United claims you can fly the friendly skies however it appears that as long as you're on the ground all bets are off! In a video most of America has seen, a man with a ticket was removed after he had legally boarded a United passenger jet Sunday. Do you suppose it ever occurred to this customer the best way to get arrested was to buy a plane ticket, show up on time and board as instructed? In case you haven't heard United demanded four passengers disembark the flight they were on because United oversold the flight. After they asked for volunteers it boiled down to a lone passenger who refused to leave. The passenger who was forcibly removed by security guards was also a physician. The video is on youtube.com for all to see.

California Ranked #1 In Pedestrian Deaths In The Nation

A just released study shows that California leads the nation in pedestrian deaths with an increase of 11% in the past 6 months. The study went on to reveal the shocking fact that almost 2 pedestrians per day die in the Golden State. The most disturbing aspect is the cause is known and the deaths preventable.

Dog Bites On The Rise In California

Kids and adults are attacked by dogs more often than most people are willing to believe. The consequences of those attacks are immediate and can be severe and even lead to death. Statistics from the Center for Disease Control suggest over 4 million people are attacked by dogs each year.

Be Careful What You Say... People Are Watching

The recent Academy Awards provided a perfect example of what can happen when you say the wrong thing at the wrong time even when it appears like you are doing and saying the right thing. Warren Beatty announced the winner for Best Picture after reading it off a card he was provided and it turns out he had the wrong card. Accident victims don't get a card to read!

California Last Call Moving To 4 a.m.?

In what can only be called a horrible idea, a California Legislator has written a bill to allow the last call in bars to move to 4am. This bill would allow each municipality to decide what their last call should be and in no event could it be made earlier than the current 2am last call time.

Dramatic Videos Of People Being Saved

As a result of almost unprecedented rainfall in Northern California we have all seen our heroic first responders rescuing people stranded in cars. The reality is that often these victims ended up stranded because they failed to heed the warning signs that were put in place to prevent this exact occurrence.

What Gets Recorded May Be Held Against You!

"As attorneys we understand the importance of individuals having access to consult with an attorney whenever they have to deal with an insurance company." We have seen too many cases where a small, seemingly meaningless comment came back to haunt someone in a detrimental manner. A recent appeals court decision emphasizes the importance of strong legal representation like you get from GB Legal.

Pedestrians At Increased Risk According To Study

If you decide to walk someplace for your health you may want to reconsider once you listen to recent studies and look at the actions of the City of Sacramento. Sacramento recently embarked on what they have termed "Vision Zero Sacramento". Vision Zero is a traffic safety initiative whose aim is a roadway with no fatalities or serious injuries. Vision Zero rejects the notion that traffic crashes are simply "accidents," but instead preventable incidents that can and must be systematically addressed.

IKEA Settles $50 Million Wrongful Death Case

Recently IKEA reached a tentative settlement for $50 Million Dollars with 6 American families whose children were killed when the Swedish company's furniture fell on them. The families sued after the children were crushed to death after a dresser or chest fell on them.
Lawyers for the families argued the furniture was designed in such a way that it was inherently unstable and easily tipped over. Lawyers for the families are referring the case and results to the Consumer Products Safety Commission.
The reason the Consumer Products Safety Council is being included in the investigation is these deaths would have likely never happened if IKEA had made the dressers in accordance with the Voluntary National Safety Standards. While the standards are voluntary, safety is not! The standards are in place to prevent accidents of this sort. The head of the Consumer Product Safety Commission issued a warning to owners of the recalled furniture "If you have or think you have one of these products, act immediately," Chairman Kaye said "It is simply too dangerous to have the recalled furniture in your home unanchored, especially if you have young children."
IKEA has taken the next step and recalled over 29 million of the chests and dressers in question in response to both the accidents and the settlement. A child dies once every two weeks on average in accidents involving toppled furniture or television sets, according to the safety commission. A report issued in 2014 by the commission said children were the victims in 84 percent of the 430 deaths reported between 2000 and 2013 from tipped-over televisions, furniture and appliances; about 65 percent of those children were between 1 and 3½ years old. The IKEA settlement represents progress for consumer advocates working since 1989 to hold the company accountable for the deaths of young children.
At the end of the day your case can only be settled one time and you need to know all of the facts beforehand. The reason that insurance companies have paid our clients in excess of $130,000,000.00 is that we get the facts and are not intimidated at the prospect of going to trial when they refuse to follow the law.
