In what can only be called a horrible idea, a California Legislator has written a bill to allow the last call in bars to move to 4am. This bill would allow each municipality to decide what their last call should be and in no event could it be made earlier than the current 2am last call time.
Passengers often feel like the odd person out after a car accident. Since they weren't the driver the odds are, with rare exception, they aren't going to be at fault. Since they are a passenger they often feel like there is no place to turn to recover financially from their injuries. We have often been told they don't want to pursue the driver if they were at fault and if the other driver was at fault the complexity of going after them as a passenger is overwhelming.
We've written about common carrier liability as a result of the litigation our office is involved in regarding Jet Blue. Recently there was another episode where a common carrier, this time a passenger bus driving on a California Highway, crashed into the rear end of a slow moving maintenance truck on a freeway.
Life can be unpredictable and there are risks we assume in our daily lives. When we place our safety in the hands of a professional driver we do it with the understanding they have the training and professionalism to get the job done right. Airplane companies are paid to provide highly skilled trained pilots who make themselves abundantly aware of the equipment they are flying and thoroughly understand other aspects like weather and how to arrive safely at their destination. Likewise, bus companies must be aware of traffic patterns, road quality and any construction where they might encounter road construction.
In this most recent crash there were 12 confirmed fatalities and another 31 were injured, some severely. The bus was returning to the Los Angeles area from a casino in Palm Springs when the accident occurred in the early hours of the morning. There was no indication the bus made any effort to stop and early speculation suggests the driver of the bus, who was also the owner of the bus, may have fallen asleep. The driver of the maintenance truck was not injured. Investigators will also look at the relationship with the casino along with maintenance issues on the bus and what that driver did in the hours leading up to the crash to see whether fatigue or some other factor might have contributed to the crash.
A tragic crash can happen to anyone. Negligent drivers are on our roads and they aren't paying attention. Some fall asleep at the wheel and there are others who are texting or driving under the influence. Any of these negligent actions can cause a fatal crash in an instant. Families affected by these accidents have specific legal rights. We are skilled in personal injury cases and uncover what happened to cause the accident and we have investigators who help prove who is at fault. Compensation may be available for medical expenses, funeral expenses, loss of companionship, pain and suffering and other damages.

It turns out California regulators are taking a dim view of Tesla Motors Autopilot. They are not yet taking issue with the system itself, just the name. In draft regulations recently released the Department of Motor Vehicles said car companies should not use the terms "Self-Driving", "Automated" or "Autopilot" in their advertising unless their cars are capable of driving themselves without a human paying attention. That is not something approved on California roads as of yet.
Hitting the gas when you mean to hit the brake happens to just about every driver at one time or another. It may happen due to distraction or just because you weren't paying complete attention to what you were doing. The reality is this lapse could be enough to result in a serious car accident. Review what we've written about these accidents and ways to prevent them.
You were injured through no fault of your own and because of the actions of another. Does that mean you have a personal injury claim or a personal injury lawsuit? The answer depends on several factors and the most important factor may come down to your representative.

The latest bright, shiny object drivers have to distract them is "Pokemon Go". In case you live in a cave this is a virtual reality game which invites you into an alternative universe. In this universe you catch virtual creatures and add them to your collection. This game is supposed to cause increased physical activity in the form of walking and human contact for those playing it. The game is targeted at those 35 & under. So far so good. Here is the rest of the story.

The natural inclination of people when you mention the word Lawyer is a slight recoil. Almost like no one wants to associate with a lawyer unless they have to and then they have to they want someone who has compassion, experience and an exceptional level of comfort in the area of law they need addressed. Ever wonder how some of the lawyers like this are created? Many of the lawyers of tomorrow are being created and trained in our local high schools and it's important they are acknowledged.
