Another Tour Bus Accident Turns Deadly

We've written about common carrier liability as a result of the litigation our office is involved in regarding Jet Blue. Recently there was another episode where a common carrier, this time a passenger bus driving on a California Highway, crashed into the rear end of a slow moving maintenance truck on a freeway.

In this most recent crash there were 12 confirmed fatalities and another 31 were injured, some severely. The bus was returning to the Los Angeles area from a casino in Palm Springs when the accident occurred in the early hours of the morning. There was no indication the bus made any effort to stop and early speculation suggests the driver of the bus, who was also the owner of the bus, may have fallen asleep. The driver of the maintenance truck was not injured. Investigators will also look at the relationship with the casino along with maintenance issues on the bus and what that driver did in the hours leading up to the crash to see whether fatigue or some other factor might have contributed to the crash.

Car Crash Where You Were Just A Little Responsible?

Many personal injury situations are pretty clear with a clear idea of the responsible party. What happens when liability is in dispute or when the situation arises that there is what's called "comparative negligence." This most often happens when the defendant claims you were at least partially to blame for the crash. This can affect the total amount of your claim. Imagine you're in a traffic crash where the other driver negligently ran a stop sign and you just happened to be driving at a speed above the posted limit at the time of the crash. The reality is you might share 10 percent of the blame for the accident while the other driver accepts 90 percent of the actual fault. Now imagine your damages add up to $15,000. Understanding this how would a shared fault situation impact your potential compensation? Under California's pure comparative negligence rule, your compensation will be reduced to $13,500 (or the $15,000 total minus the $1,500 that represents your share of fault for the accident.)

California DMV Pressures Tesla For Change

It turns out California regulators are taking a dim view of Tesla Motors Autopilot. They are not yet taking issue with the system itself, just the name. In draft regulations recently released the Department of Motor Vehicles said car companies should not use the terms "Self-Driving", "Automated" or "Autopilot" in their advertising unless their cars are capable of driving themselves without a human paying attention.
