A recent report from the National Highway Traffic Safety Administration reveals fatal traffic accidents increased at the alarming rate of over 8% in the first 9 months of last year. Another aspect of this report is the reality that most of these aren't accidents and instead should be defined as automobile crashes due to the reality of an accident being outside of someone's control.

IKEA Settles $50 Million Wrongful Death Case

Recently IKEA reached a tentative settlement for $50 Million Dollars with 6 American families whose children were killed when the Swedish company's furniture fell on them. The families sued after the children were crushed to death after a dresser or chest fell on them.
Lawyers for the families argued the furniture was designed in such a way that it was inherently unstable and easily tipped over. Lawyers for the families are referring the case and results to the Consumer Products Safety Commission.
The reason the Consumer Products Safety Council is being included in the investigation is these deaths would have likely never happened if IKEA had made the dressers in accordance with the Voluntary National Safety Standards. While the standards are voluntary, safety is not! The standards are in place to prevent accidents of this sort. The head of the Consumer Product Safety Commission issued a warning to owners of the recalled furniture "If you have or think you have one of these products, act immediately," Chairman Kaye said "It is simply too dangerous to have the recalled furniture in your home unanchored, especially if you have young children."
IKEA has taken the next step and recalled over 29 million of the chests and dressers in question in response to both the accidents and the settlement. A child dies once every two weeks on average in accidents involving toppled furniture or television sets, according to the safety commission. A report issued in 2014 by the commission said children were the victims in 84 percent of the 430 deaths reported between 2000 and 2013 from tipped-over televisions, furniture and appliances; about 65 percent of those children were between 1 and 3½ years old. The IKEA settlement represents progress for consumer advocates working since 1989 to hold the company accountable for the deaths of young children.

Another Tour Bus Accident Turns Deadly

We've written about common carrier liability as a result of the litigation our office is involved in regarding Jet Blue. Recently there was another episode where a common carrier, this time a passenger bus driving on a California Highway, crashed into the rear end of a slow moving maintenance truck on a freeway.

There was no indication the bus made any effort to stop and early speculation suggests the driver of the bus, who was also the owner of the bus, may have fallen asleep. The driver of the maintenance truck was not injured. Investigators will also look at the relationship with the casino along with maintenance issues on the bus and what that driver did in the hours leading up to the crash to see whether fatigue or some other factor might have contributed to the crash.
