Johnson & Johnson along with 4 subsidiaries have agreed to pay $120 Million to settle allegations they violated State consumer protection laws by misrepresenting the safety and effectiveness of the DePuy hip implant device. California will receive $8 million dollars of the settlement according to State Attorney General Xavier Becerra.
Much of the evidence revealed in this case was shocking in regards to what DePuy did with the Pinnacle hip. Internal corporate documents showed Johnson & Johnson and DePuy proactively worked to conceal known problems with these hips from doctors. The companies engaged in outrageous conduct during the marketing of this product. Additional allegations included clinical trials were falsified, and advertising was based on these falsified clinical trials. Internal documents showed that several doctors were bribed and given money to use this hip and then tell other doctors what a great deal it was. Some doctors received millions of dollars. One of the main witnesses for the defense received over $7.5 million dollars in royalties from DePuy.
