Richard Tulecki “slipped and fell on a wet foreign substance” near the restroom of a restaurant in in July 2019, according to his lawyers. The January 2021 lawsuit claimed the fall caused him to suffer “serious injuries.” The lawsuit alleged the Burger King franchisee breached its duty of care by exposing customers to a hazard.

On May 11, 2023 A jury reached a verdict in favor of Tulecki and awarded him damages of $7.81 million, including $3.35 million related to loss of earnings and around $700,000 for medical expenses. The total award was reduced to $7.68 million based on medical expenses covered by the plaintiff’s insurance. The slip and fall gave Tulecki lower back injuries that required surgery and that surgery was complicated by a post-operative perforated colon his lawyers said in a press release.
