The trial lasted just 3 weeks and the case alleging there was a defect in a 2006 fatal crash of a Toyota Camry has finally gone to the jury.  There is a lot resting on the shoulders of the 6 men and 6 women of the jury.  These people must decide if the design of the Toyota contained a defect that was unreasonably dangerous to the drivers of those cars.

The driver of that Toyota, Koua Fong, was actually in prison for 2½ years as a result of the accident.  The charges against him included criminal vehicular homicide.  Those charges were dropped after the court learned that several independent reports suggested that some Toyota cars like Mr. Fong was driving had sudden acceleration problems and this is what he reported at the scene of his accident.

The design of the Toyota has been in question for quite some time and Toyota has maintained their innocence.  As more and more complaints started to rise to the surface it became evident that there was a bigger issue at foot and Toyota started a nationwide recall of several models.  It is wise to keep in mind that Toyota also manufactures Lexus and Scion.  Lexus is marketed to a higher end client and Scion to a younger market.  The drivers of each make and model deserve a safe product that functions as designed.

The jury has a lot of work to do in this case.  Do they side with the driver who has maintained that his car suddenly accelerated in the same manner as so many others have claimed or do they side with the company that made the product that so many others have complained about?  Only time will tell. From our point of view it’s quite telling that Toyota decided to fix the very thing that Mr. Fong and so many others complained about and that caused so many deaths and injuries.
