E-Scooter Company Threatens To Sue Injured User For Getting Injured

After suffering what could be called catastrophic injuries following a Bird scooter accident the victim has now been billed by the company! Daniel Pena suffered injuries in a Bird scooter accident in Los Angeles that left him paralyzed. As a result of the crash Mr. Pena now requires help paying medical and other expenses related to his crash. Pena is in the process of taking legal action against the City of Los Angeles and claims a damaged sidewalk was the actual cause of his accident.

Pena was riding a Bird scooter on the way to a job interview on a sidewalk on La Brea when the crash happened. Pena collided with a tree while falling and suffered lasting damage. According to a television report Pena was shocked after getting a demand letter stating he owed the scooter company $322,000. Pena says it was the broken sidewalk caused him to lose control of the scooter and doctors have said he may never walk again.

Court documents contain photos of uneven pavement along with trash and other debris at the crash site. Pena’s lawsuit alleges the city failed to maintain the tree, which contributed to the condition of the sidewalk. As part of its agreement with the city of Los Angeles, Bird scooter company is supposed to indemnify or protect the city against lawsuits. In a letter, Bird’s attorneys told Pena that he owes the company about $322,000 in legal fees. Those terms are in the fine print when you rent any scooter from Bird and renters seldom read the fine print. When the television station contacted Bird seeking a comment the company assured investigators that they would not sue Pena and had no intention of collecting any money from him.

A study from UCLA study shows the injury rate for riders of electric scooters in one section of Los Angeles was higher than the national rates for riders of motorcycles, bicycles, cars, and pedestrians. The study also determined that those people injured in e-scooter accidents included not only the vehicle’s riders but also pedestrians who were hit by moving e-scooters or who tripped over parked e-scooters. They further found these victims were treated for injuries to the head and extremities. Overall, of the 1,354 patients who were part of the study, 533 sustained injuries to more than one part of the body, 72 were admitted to the hospital, 21 were sent to the critical care unit and two died from their injuries.
