Allstate, State Farm and USAA delivered another potentially staggering blow to PG&E as a result of their potential blame in the recent wildfires in Santa Rosa and Paradise. PG&E already faces problems and allegations of negligence as a result of the Camp fire and these insurance companies among others expect to pay billions of dollars in claims as a result of these fires.
Cal Fire is currently investigating the cause of the Camp fire and has not yet released any cause. The insurance companies are placing the blame squarely on the shoulders of PG&E. The companies argue the company did a poor job of maintaining its powerlines, towers and other equipment in a responsible manner. Allstate suggested “Plaintiffs (Insurance companies) have suffered damages caused by an act or omission of defendants (PG&E)” in their December 21, 2018 lawsuit filing. State Farm accused PG&E of “Failing to keep its power lines, wires, and any and all associated equipment in a safe condition at all times to prevent fires.”
The wildfires are putting some insurers under severe financial strain. A small company, Merced Property & Casualty, was declared insolvent in early December and as a result their claims will be paid by an industry funded guaranty association to a maximum of $500,000. Beside civil claims PG&E could also face criminal penalties over the Camp fire and the deadly blazes that struck the Santa Rosa area in 2017. Federal prosecutors secured felony convictions against PG&E after the deadly 2010 San Bruno pipeline explosion and are currently on probation. Xavier Beccera, California attorney general has stated publically the utility could be prosecuted for murder in the Camp fire case.
