We see this happen all the time in our office. We have a responsible member of the community we serve who has been involved in an accident through no fault of their own. The driver who hit them is either uninsured or dramatically underinsured and when we ask they tell us they have full coverage insurance.  Sadly, after doing a little bit more investigation we often find they are dramatically underinsured and what they thought was “Full Coverage” is often the absolute “Minimal Full Coverage” available.  How does this happen, how does this impact them and how can this be avoided.

Car insurance is often viewed as a necessary evil until you need what it covers. When that time comes, and sadly that happens for most drivers, it’s critically important to have what you need and as much as you need.  Full coverage typically includes medical payments, comprehensive, collision, liability, uninsured and underinsured motorist.  Possibly the most important thing to have are liability limits to protect your assets from claims of others and uninsured/underinsured limits to cover any loss you suffer yourself.

As lawyers we recommend the highest limits you can reasonably afford. Many insurance agents sell you less than is prudent to keep the premium lower and this keeps you with their agency.  This is a critical error.  Higher limits typically become less expensive as they increase.
