As a personal injury advocate, one of the most common questions I hear is, “What is my case worth?” It’s a critical question, and the answer is rarely simple. The value of a personal injury claim is determined by a combination of factors, some of which are more tangible than others. While a formulaic approach might seem appealing, the truth is that the most significant variable is often the human element, and specifically, the reputation of your attorney.
First, let’s look at the quantifiable factors that form the foundation of any case valuation. These are the “economic damages” and include all of your out-of-pocket expenses. We’ll meticulously calculate the cost of your past and future medical bills, from emergency room visits and surgeries to physical therapy and prescription medications. Lost wages and future lost earning capacity are also factored in. We will consider the property damage to your vehicle or other belongings, and any other costs directly resulting from the accident.
Beyond the numbers, we evaluate “non-economic damages”—the more subjective, but often more valuable, part of the claim. This includes compensation for pain and suffering, emotional distress, and the loss of enjoyment of life. These damages are harder to quantify, but are profoundly real. The severity and permanence of your injuries, as well as the impact they have on your daily life, are key to this part of the valuation.
Finally, we consider liability and comparative negligence. California operates under a pure comparative negligence system, meaning that even if you are partially at fault for the accident, you can still recover damages—though your compensation will be reduced by your percentage of fault. A clear case of liability on the part of the other party will significantly increase the value of your claim.
These factors are crucial and they are only part of the story. The single most important factor that influences the final value of your case is the reputation of your attorney. Insurance adjusters and defense lawyers are not working on your behalf. Their job is to pay as little as possible and when they see a demand letter from a lawyer with a reputation for taking cases to trial, they know they can’t make a lowball offer and expect the case to go away. Our name tells them we are serious about your claim and are prepared to fight for a fair settlement in court if necessary. Having GB Legal means you don’t just have an advocate, we are a deterrent to an unfair settlement.
We represent people injured as a result of the careless and reckless acts of others. At the end of the day your case can only be settled one time and you need to know all of the facts beforehand. Insurance companies have paid our clients hundreds of millions of dollars in compensation because we uncover the facts. When insurance companies fail to offer full compensation, we are not intimidated at the prospect of going to trial. We help with serious injuries that require serious representation. We are the Law Offices of Guenard & Bozarth, LLP. Our attorneys have more than 60 years of experience specializing in only representing injured people. Never in my life did I think I would recommend an attorney. Somehow God sent this angel of an attorney to assist me in my personal injury lawsuit. I was told by lawyers in Bakersfield that my lawsuit was frivolous because there was money in it.
